MY CAT IS GARFIELD CONTEST

 

OFFICIAL RULES

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

1.        CONTEST PERIOD/ENTRY DEADLINE: Contest begins October 18, 2004 at 12:00:01 p.m. (Pacific Time [“PT”]).  Entries must be received by November 1, 2004 at 12:00:00 p.m. “Noon,” (Pacific Time [“PT”]).  Entries received after November 1, 2004 at 12:00:00 p.m. ‘Noon,” PT will not be eligible for judging.  Ten (10) Finalists will be posted on the Contest website (www.mycatisgarfield.com) on November 2, 2004.  Contest ends November 29, 2004 at 11:59:59 a.m. PT.  The Grand Prize Winner will be announced on November 30, 2004. 

2.        ELIGIBILITY:  The contest, and any web site pages and advertisements relating thereto, is intended for viewing only within the United States.  You are not authorized to participate in the contest if you are not located within the United States. To enter the contest you must be a permanent lawful resident of the United States and be 13 years of age or older.  If you are under 13 years of age you are ineligible.  Contest is void in Puerto Rico, U.S. territories and possessions outside the United States and where prohibited or restricted by law.  Employees of Twentieth Century Fox Home Entertainment (the “Sponsor), NCOMPASS, the independent judges, and all of their respective affiliated, parent, and subsidiary companies, and their advertising and promotion agencies, their respective officers, directors, employees, representatives and agents, (collectively, the “Contest Entities”), and their immediate families and members of their households, are ineligible to participate in this contest.  To enter, you must be the legal owner of the cat upon which the entry is based.

3.        HOW TO ENTER

A.       Log on to www.mycatisgarfield.com (the “web site”) and click on the ENTER NOW icon to access the Entry Form.  In Step One, you must complete and submit the requested information, including name, email address, current mailing address, date of birth and telephone number. 

B.       In Step Two, you must submit a completed Entry Form.  Failure to properly complete and submit an Entry Form will result in your disqualification.  The Entry Form requires the entrant to complete the statement:  “My Cat is Like Garfield Because…” in fifty (50) words or less in the designated space (“the Statement”).  See Judging Criteria below for details on how the statement will be judged.

C.       The Entry Form also requests that you submit a photograph of your cat which demonstrates your cat’s unique personality.  Your cat may appear alone, or with other animals or items.  Photographs may not include human beings.  Any entries including photographs which depicts human beings will be disqualified.  You are permitted to use props, musical instruments, uniforms or costumes.  See Judging Criteria below for details on how the photograph will be judged.   200K maximum file size for entry photographs.

D.       By submitting an Entry Form, you agree that the photographic image of your cat will become the sole property of Twentieth Century Fox Home Entertainment, and will not be returned.  Contestant further agrees to permit Contest Entities the right to reproduce such submission in full or to crop or otherwise edit or modify submission for reproduction at Sponsor’s sole discretion.  By submitting an Entry Form, you grant Twentieth Century Fox Home Entertainment, the worldwide and perpetual right and authority to use, publish, display and reproduce the photograph and all the elements of the photograph, and “The Statement”, or any portion of “The Statement” provided by you, on a website or other forms of media, without compensation.

4.        SELECTION OF FINALISTS/JUDGING CRITERIA: All eligible entries will be judged and scored by a panel of judges in their sole discretion based on the following criteria and with the following weight given to each such criteria: 1) Similarity of Appearance to Garfield Demonstrated in Photograph (1/3); 2) Personality of Cat Demonstrated in Photograph (1/3); 3) Personality of Cat Demonstrated in Written Statement (1/3), (the “Judging Criteria”).  In the event of a tie, the contestant with the highest Similarity of Appearance score will be declared the winner. There will be a total of ten (10) finalist winners.  All eligible entries will be collected and judged commencing October 18, 2004 at 12:00:01 p.m. PT and ending November 1, 2004 at 12:00:00 p.m. “Noon,” (Pacific Time [“PT”]).  The finalist winners’ statements and photographs will then be posted on the Contest Website and judged and scored by a panel of judges in their sole discretion according to the Judging Criteria for the selection of the First Prize and Grand Prize winners.  Odds of winning a prize depend on the number of eligible entries received and the quality of such entries.

5.        RESTRICTIONS:  Any statement or photograph containing obscenity, crude language, nudity, depictions of a sexual nature, pornographic depictions, violence or other inappropriate conduct or language (as defined solely by the Sponsor) will not be accepted and will result in disqualification.  All contestants warrant that the use of the photographs within this contest is authorized by all persons having rights with respect to the photograph, and its use in this contest will not violate the rights of any third parties. 

6.        LIMITATIONS:  Sponsor will not be responsible for lost, misdirected, illegible, incomplete, or delayed entries. Limit of one entry per person. If more than one entry is received from the same person, then he/she will be disqualified.  Limit of one Finalist Prize per household. 

7.        Only complete entries will be accepted.  If a submission is incomplete or does not comply with the specifications and rules described herein, then the submission will be disqualified and there will be no entry in the contest.  Neither Twentieth Century Fox Home Entertainment or its promotional partners, nor NCOMPASS will verify receipt of entries.  You should retain a copy of all materials submitted for the contest.  All entries (including all photographs) become the property of Sponsor and will not be returned.

8.        PRIZES: One (1) Grand Prize:  A hand drawn sketch of Cat and Owner by Garfield creator Jim Davis, a $250 PETCO Gift Card, a Subscription to Cat Fancy© Magazine and a copy of “Garfield: The Movie” DVD.  Prize valued at $2,300.00.  Nine (9) First Prizes: A $25 PETCO Gift Card, a subscription to Cat Fancy © Magazine, and a copy of “Garfield: the Movie” DVD.  First Prize valued at $80.00.  Total value of all the prizes is $3,020.00.  Prizes cannot be assigned, transferred, changed or redeemed for cash value.  No substitutions of prizes permitted unless prize cannot be awarded as described for any reason. Sponsor reserves the right to substitute a prize of equal or greater value at Sponsor’s sole discretion due to prize unavailability, unless prohibited by law.

9.        NOTIFICATIONS AND RELEASES: If a potential Grand Prize winner cannot be reached by telephone, email or mail within three (3) calendar days from the first notification attempt, then such contestant may be disqualified and another contestant with the next highest score may be chosen in his/her stead. The decisions of the judges relating to the judging of all contestants are final.  The winners will be required to execute an Affidavit of Eligibility and a Liability and Publicity Release (“Affidavit/Release”).  All Affidavits/Releases and Publicity Release forms must be returned by the date noted on the forms. If such documents are not returned within that time, or if any contestant is found to be ineligible, or if he/she does not comply with the Official Rules, then such contestant will be disqualified and an alternate contestant may be selected as a winner.  If any prize or prize notifications are returned as undeliverable, this will result in disqualification of the contestant and an alternate winner may be selected in accordance with the rules of this contest.

10.     CONTEST CONDITIONS: This contest is subject to all applicable federal, state and local laws.  All federal, state and local taxes are the sole responsibility of the winners.  Except where prohibited by law, each winner’s entry or acceptance of the prize constitutes permission for the Contest Entities to use, publish, and display the winner’s photo submission, name, voice, photograph, and other likeness and/or any biographical information the winner may provide, and any statement the winner may make concerning the contest or the prizes, in any and all media, in perpetuity, for promotional and marketing purposes, without notification or compensation, all as detailed in the Publicity Release.  Winner further agrees to permit Contest Entities the right to reproduce such submission in full or to crop or otherwise edit or modify submission for reproduction at Sponsor’s sole discretion.  By participating, contestants agree to be bound by these Official Rules and the decisions of the Sponsor, the judges and the Contest Administrator, and waive any right to claim ambiguity in this contest or these Official Rules.  Winners and contestants also agree to release, discharge, indemnify and hold harmless the Contest Entities, and the officers, directors, employees and agents of each, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any contest-related activity or participation in this contest, including any claims relating to use, misappropriation or disclosure of the photo and any materials submitted herein.  All decisions of the judges and the Contest Administrator are final in all matters relating to this promotion. If for any reason this contest is not capable of running as planned, then Sponsor reserves the right in Sponsor’s sole discretion to cancel, terminate, modify or suspend the contest.  Winners are ineligible if they are not the legal owner of the cat upon which the entry is based. 

11.     RULES/WINNERS LIST: To view the Official Rules and/or the list of the winners, go to www.mycatisgarfield.com or send a self-addressed stamped envelope to: Post Office Box 1-439, West Hollywood, Ca. 90069.  Please specify “Rules” or “Winners List”.  VT residents may omit return postage.  Winners list available after November 30, 2004.

14.     LIMITATION OF LIABILITY:  Sponsor, Contest Administrator and related entities are not responsible for late, lost, damaged, misdirected, incorrectly addressed, incomplete, illegible, undeliverable, or destroyed materials, or the acts or omissions of any other entity’s computer, or other telecommunications malfunctions which may limit or prevent an entrant’s ability to participate.  Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, or if entrant has or had attempted to submit malicious code, .exe files, or any file that contains malicious code.  If for any reason this Contest is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsor, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest, except were prohibited by law. 

15.     CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE, SUBMIT MALICIOUS CODE, .EXE FILES, OR ANY FILE THAT CONTAINS MALICIOUS CODE,  OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
